CHAPTER 31
CASE CLOSED
The base commander was not happy to hear from Detective Hubbard, who was requesting all Pettipointâs records be reevaluated by an independent panel to see if the information that he had been convicted with was coerced, or worse, fabricated. He did not find Hubbardâs accusations worthy of discussion. He sternly warned Hubbard that the prisoner Robin Pettipoint was convicted in a fair and impartial military trial by a group of his peers who found him guilty of all charges. The conviction was just, especially in light of the signed confession that was obtained from Pettipoint in his own hand admitting to all charges.
If Detective Hubbard had a problem with the courtâs findings, he would need to follow military protocol and submit his complaints to the Uniform Justice bureau for further review. As far as Samâs request for the transcripts of the trial and findings by the military police, he would take it under advisement, which was the polite way to say, âFuck off, civilian.â
All access to Pettipoint for future visits was cut off, so Sam started writing the first of many letters to the military Uniform Justice department requesting the case be reopened and Pettipoint have an independent psychological evaluation. He spelled out his own qualifications as a mental health expert and argued that in his professional opinion, Seaman Pettipoint was not mentally stable and his state of mind would not have allowed for a competent confession to be obtained. Pettipoint was sick and needed treatment, and a maximum security prison surrounded by real criminals was not the appropriate facility.
Sam felt badly for Pettipoint, who he knew was caught in some legal hell that would probably take years to unwind, if ever. Pettipointâs best hope was for Sam to try and find the actual killer, who may have been tied to his own nephewâs death.
No common denominator had been shown between the two deaths other than Bill did appear to have at least been acquainted with Petty Officer Smith. This had been verified by a local bar owner in Seal Beach whose establishment both men frequented. It was unclear whether the men had been together the night they had died. No witness had been located to verify this either way. Sam would have to continue using his police ties to determine if any other connection between the two existed. He needed the complete file on Smith and up to this point no one was sharing.
